1. Acceptance of Terms
These Terms of Service govern access to and use of the Pet Attix platform. By creating an account, listing an item, purchasing an item, messaging through the platform, or otherwise using the services, users agree to be bound by these terms, the Privacy Policy, Buyer Protection Policy, Seller Policy, Postage Policy, Prohibited Items Policy, and any additional rules published by Pet Attix.
2. Eligibility and Accounts
Users must be at least 18 years old, capable of entering into legally binding contracts, and permitted by law to use the services. Users must provide accurate, current, and complete information, keep account credentials secure, and update account details where necessary. Pet Attix may request identity verification, address verification, bank verification, or other information before permitting transactions, messaging, listing, or payouts. Users may not transfer, sell, or rent accounts, create accounts for deceptive purposes, or use multiple accounts to evade restrictions or manipulate platform systems.
3. Marketplace Role
Pet Attix is a platform provider and marketplace intermediary only. Except where expressly stated otherwise, Pet Attix does not own, take title to, warehouse, inspect, manufacture, certify, or endorse user-listed items. Sale contracts are formed directly between buyer and seller. Pet Attix is not a common carrier, customs broker, insurer, or product guarantor. We may facilitate payments, buyer protection, shipping labels, moderation, and support, but those services do not make Pet Attix the seller or transfer seller responsibility to Pet Attix.
4. Listings and Sales
Sellers are responsible for ensuring listings are truthful, complete, lawful, and not misleading. Listings must accurately describe condition, hygiene status, defects, materials, sizing, functionality, and any relevant warnings or suitability limits. Sellers must use genuine photos that fairly represent the actual item. Pet Attix may edit, reject, hide, demote, or remove listings that breach policy, present legal risk, appear misleading, or may endanger users or animals.
5. Orders, Payments, and Fees
All purchases must be completed through the platform using approved payment methods. Payments are processed by Stripe and related providers. Pet Attix may charge seller fees, buyer protection fees, shipping-related fees, currency conversion fees, promotion fees, or other clearly disclosed charges. A Buyer Protection Fee applies to eligible transactions and funds payment security, fraud controls, customer support, and dispute resolution services. The Buyer Protection Fee is displayed before checkout and is non-refundable except where required by law or where Pet Attix expressly states otherwise.
6. Payouts and Seller Verification
Seller payouts may be subject to verification, reserve periods, delayed settlement, transaction review, compliance checks, and Stripe Connect onboarding requirements. Pet Attix may withhold, delay, offset, or reverse payouts where reasonably necessary to manage refunds, disputes, chargebacks, fraud concerns, sanctions compliance, tax reporting, prohibited activity, or seller breaches. Sellers are responsible for the accuracy of payout details and may be required to provide tax, identity, banking, or business information before accessing proceeds.
7. Shipping and Completion
Sellers must dispatch sold items within the required timeframe and comply with the Postage Policy. Buyers must provide an accurate address and cooperate with delivery where required. Pet Attix may treat a transaction as complete when tracking confirms delivery, when the buyer confirms receipt, or after a defined period passes without a qualifying issue being reported. Completion timing may vary by territory, shipping method, or risk review.
8. Buyer Protection and Disputes
Transactions may be eligible for buyer protection in accordance with the Buyer Protection Policy. Pet Attix may request photos, videos, message history, tracking, packaging evidence, proof of condition, receipts, expert information, or any other supporting material reasonably required to investigate a claim. Users must cooperate in good faith and within stated timeframes. Pet Attix may make final determinations on platform remedies, including refunds, partial refunds, returns, payout reversals, or claim denial, subject to applicable law.
9. Prohibited Conduct
Users must not sell prohibited items, misrepresent goods, harass others, manipulate reviews, abuse refunds, bypass fees, move transactions off-platform, engage in fraud, list stolen goods, infringe intellectual property rights, upload unlawful content, scrape the platform, reverse engineer restricted systems, or use the platform in a way that creates legal, reputational, or operational risk for Pet Attix or its users. 1
10. Suspension, Restriction, and Termination
Pet Attix may suspend, restrict, or terminate accounts, listings, transactions, messaging privileges, payouts, or access to certain features at any time where reasonably necessary to protect users, pets, payment systems, legal compliance, or platform integrity. Grounds may include policy breaches, fraud indicators, suspected counterfeit activity, sanctions concerns, abusive behaviour, repeated non-compliance, excessive disputes, fake engagement, chargeback abuse, or failure to provide requested verification. Where appropriate, Pet Attix may cancel transactions, refund buyers, remove content, and retain records for compliance or evidential purposes.
11. Intellectual Property
Users retain rights in content they create, but grant Pet Attix a non-exclusive, worldwide, royaltyfree licence to host, use, reproduce, adapt, distribute, and display that content for operating, promoting, securing, and improving the services. Users must not upload content that infringes the rights of others. Pet Attix may remove allegedly infringing content and may terminate repeat infringers.
12. Disclaimers and Limitation of Liability
To the fullest extent permitted by law, the platform and services are provided on an 'as is' and 'as available' basis. Pet Attix disclaims implied warranties to the extent lawful, including implied warranties of merchantability, fitness for a particular purpose, non-infringement, and uninterrupted availability. Pet Attix is not responsible for product defects, contamination, pet injury, misuse of products, user content, acts or omissions of buyers or sellers, carrier errors, customs delays, losses caused by inaccurate addresses, or third-party payment outages. To the fullest extent permitted by law, Pet Attix will not be liable for indirect, incidental, special, consequential, or punitive damages, or for loss of profit, revenue, goodwill, data, or opportunity. Nothing in these terms excludes liability that cannot lawfully be excluded, including certain liability for death or personal injury caused by negligence, fraud, or statutory consumer rights.
13. Indemnity
Users agree to indemnify, defend, and hold harmless Pet Attix, its affiliates, directors, officers, employees, contractors, and agents from and against claims, liabilities, losses, damages, fines, penalties, judgments, costs, and expenses, including reasonable legal fees, arising out of or related to their listings, sales, purchases, user content, breach of these terms, violation of law, infringement of rights, unsafe or contaminated products, customs violations, tax failures, or misuse of the platform.
14. Governing Law and Jurisdiction
For UK operations, these terms are governed by the laws of England and Wales, unless mandatory local consumer law requires otherwise. As Pet Attix expands globally, additional territory-specific consumer rights, tax, and regulatory requirements may apply. Nothing in these terms is intended to deprive a consumer of mandatory protections under applicable law.
15. Changes to the Terms
Pet Attix may amend these terms from time to time. Updated terms may be posted in the app or website and may be notified by email, in-app notice, or other reasonable means. Continued use of the services after the effective date of updated terms constitutes acceptance, except where additional consent is required by law.
